Managing Liability Exposure and Minimizing Litigation Risks

When a charter school gets sued, it can be forced to spend precious resources to defend itself in court. From labor and employment claims to student injuries on field trips, charter schools regularly face a wide variety of liability risks without all the immunity protections afforded traditional district schools. Enacting policies and procedures can help to minimize the risks and aid in a defense, should a lawsuit be filed against your school. And while many school leaders assume the school’s insurance will cover all the costs, varying insurance provisions and exclusions often leave the school holding the bag. This presentation provides an overview of the most common lawsuits charter schools face and how to minimize exposure to the school. We will also cover best practices when using waivers of liability, including those related to COVID-19.

School Site Expansion: Choosing New Locations and Facilities

While many charter schools rely on Prop. 39 for their facilities, charter schools are also leasing, purchasing, improving, and constructing their own facilities. This session will provide an overview of the different ways that charter schools have creatively acquired private facilities to meet the needs of their unique programs. Understanding all the requirements (zoning, building code compliance, CEQA) for facilities is critical, to avoid being stuck in a lease or facilities use agreement that is unaffordable or that contains harsh or unfair terms. This session will provide an overview of the many different issues that charter schools must think about in identifying and improving facilities for their use, as well as strategies for negotiating the best terms for leases and facilities use agreements.
